Concord Man Arrested Four Times in Four Weeks

Cody Swanson is facing charges after incidents downtown.

A local man was held on $500 cash bail after being arrested two weeks ago after numerous incidents and charges in the previous month.

Cody Alexander Swanson, 21, of Concord, was arrested on June 2, June 16, June 21, and July 1, on various charges, according to arrest reports and a court affidavit.

According to the reports, the first incident occurred at around 6 a.m. on June 2, when police were sent to the Statehouse Plaza to check on the welfare of several subjects sleeping on the lawn. Other officers were sent there and two men were found: Swanson and Joshua Taylor, and both had active warrants.

Swanson had an active warrant out of Hillsborough County Superior Court from May 22, for nonpayment of fines, $831.88, cash to settle, and was arrested. During a search of his pants, a needle was found in his left pants pocket.

“He told me that the needle was used and that he was a heroin user,” the officer alleged.

Taylor was also arrested

The second incident occurred around 9:10 p.m. on June 18, when police were sent to the area of North Main and Centre streets for a report of intoxicated men possibly heading to the Cumberland Farms on North Main Street. The first officer located the men in the parking lot.

One, Jason William McCormick, 37, had an electronic bench warrant for nonappearance in court on a criminal trespass charge in Nashua and he was arrested. McCormick allegedly told the officer that he kept missing his Nashua court dates because he forgets and doesn’t have any way to get down there.

The second man, Swanson, had a no trespass letter on file for the store from June 4. He reportedly denied it, at first, stating that he had no plans to go to the store and wasn’t on the store’s property, just on the sidewalk. He later allegedly admitted to having received the letter and been on the property and was arrested on a criminal trespass charge.

Both were released on personal recognizance bail.

Three days later, police were sent to Pitman Street for a report of “intoxicated individuals who were screaming and yelling in front of the building.” The officers later found two men on Court Street near Montgomery and one recognized Swanson from previous contacts.

“While speaking with Swanson, I observed his eyes to be glassy and bloodshot, and an overpowering odor of an alcoholic beverage was coming from his breath and person,” the officer alleged. “Swanson displayed severe mood swings and appeared unsteady on his feet.”

Swanson allegedly admitted to drinking but said it was not excessive. His bail conditions though required that he not be drinking and he was arrested on a default charge and held on $2,000 cash bail.

In the fourth incident, police were sent to the alley behind the Vegas Block Apartments on North Main Street at 1:30 a.m. on July 1.

Officers on bike patrol discovered five individuals hanging out in the alley near Dixon Avenue with an open 1.75 liter bottle of Honey Whiskey.

“The bottle was open and had approximately an inch of whiskey left in the bottle,” the reporting officer stated, adding that all of them appeared to be drinking, “given their behavior.”

The officers identified all involved and one allegedly stated he didn’t have an ID and his name was “Sam Swanson.” One of the officers thought he recognized Swanson from previous contacts and the reporting officer walked back over and addressed Swanson as “Sam” three times, but he didn’t respond. When addressed as “Mr. Swanson,” he allegedly responded. Previous bail conditions required that he stay away from alcohol and he was arrested.

During a search of his persons, the officer allegedly found an unused hypodermic needle in his pocket. He was charged with default or breach of bail conditions, false report to law enforcement, and consumption of liquor on public property, and held on cash bail.
