Concord Man in Trouble Again

Police allege that Carey Spear was drinking at Market Basket and resisted arrest.

A Concord man, with a history of alcohol related arrests, was busted again earlier this month.

Carey J. Spear, 42, of Concord, was arrested at 6:55 p.m. on Sept. 2, and charged with generic city ordinance violation and resisting arrest or detention.

While patrolling the Capitol Shopping Center Plaza on Storrs Street an officer saw a heavy set man attempting to move a stack of food pallets in front of Market Basket, according to an arrest report. The man wasn’t wearing a uniform that a store employee would wear and there were two other men were also at the scene.

As the officer exited the cruiser, the two men walked towards the officer. The officer spoke to the men and asked if they worked for the store. One said, “No way.” The officer noticed an open can of 24-ounce Natural Light Beer and asked who owned the can and one man pointed to Spear and alleged it was his.

The officer spoke to Spear and asked him what he was doing and later, showed him that there were signs on the posts saying “No Loitering.”

“It was clear to me that Spear was intoxicated,” the officer alleged, noting that he was “unsteady on his feet and was using the wall to support his body.”

Spear later denied that the open beer can was his.

Another officer arrived at Market Basket as the officer asked if Spear had someone he could call so he didn’t have to be taken into protective custody and he said, “Call my mother.”

Another officer called Spear’s mother and she said she wouldn’t get him if he was intoxicated. A friend though later agreed to pick up Spear.

While this was going on, a Market Basket employee gave officers a no trespass letter that was issued to Spear previously and the officer issued him a summons.

Spear, however, allegedly refused to take it, and the officer warned that he would be arrested on an open container charge if he didn’t. After he refused to take it again, the officers arrested him.

“F-ck you guys,” Spear allegedly said as officers attempted to cuff him.

“Spear physically resisted our attempts to place him in handcuffs (by) pulling against out attempts to get his hands behind his back,” the officer alleged, while Spear kept yelling.

Later, Spear was contained. He refused bail and was arraigned on Sept. 3.

Previously, Spear was arrested in December 2012, as well as April and May of this year.
