According to a loss prevention employee at the store, one of the employees suspected Osman of “suspicious behavior” in the store’s men’s bathroom. Osman was allegedly seen opening the bathroom door, looking around, and then shutting the door again, while staying in the bathroom.

Employees went into the bathroom and heard “suspicious noises” coming from one of the stalls. Upon opening the door, the employees alleged that they saw Osman standing in the stall with five Go Phones, valued at $99 each, hidden behind the toilet. One of the phones was later allegedly found in Osman’s pocket, taken from its packaging.

During the questioning by the officer, Osman allegedly stated that Dhital was in the store with him earlier but was now in a van in the parking lot.

The other officer spoke with Dhital who allegedly stated that he was with Osman to buy a camera.

An active bench warrant came up on Dhital during questioning and he was arrested. While being cuffed, Dhital allegedly tried to pull away but was later controlled and cuffed.

After speaking to more employee witnesses, Osman was arrested and charged. Police allege that he was in possession of another phone in a coat pocket, as well as cables and batteries, which were later determined to be a part of the two kits Osman allegedly cut open. A utility blade was found in his front pocket, the report alleged.

Both Dhital and Osman refused bail and were arraigned on Jan. 9.
