Concord Man Faces Burglary Charge

Allegedly breaks into Cole Gardens, flees the scene.

Broken glass, a mountain bike, a broken cash register, and a hypodermic needle were all allegedly part of the scene of the crime and a recent arrest when a Concord man allegedly broke into in late April.

According to an affidavit, the owner of Cole Gardens was notified by his alarm company that an alarm was activated at the business at about 7:20 a.m. Since he was on his way into work anyway, Cole declined police assistance.

When he arrived, the owner found a broken window in the rear of the building and a mountain bike leaning against the building below the broken window. The owner also found that a dead bolt on the rear door was unlocked but nothing else on the outside of the building seemed out of place.

While checking the inside of the store, the owner allegedly saw a man standing outside the building where the bicycle was. The owner reportedly confronted the man, later identified as . Osgood allegedly told the owner that he had left his bike at the store the night before and went to Chichester to visit his girlfriend. He allegedly left it there so it wouldn’t get stolen.

The owner then called the police and Osgood allegedly told him that it would look bad that he was there and took off toward Loudon Road.

After the police arrived, the owner of the store gave them a description of Osgood and walked them through the store, but told police he didn’t see anything stolen or amiss inside the store.

Police reportedly scoped the situation outside the store and gathered evidence, including tire tracks and sneaker prints from around the store.

About two hours after the initial alarm activation, another officer spotted a man resembling the description of Osgood on his bicycle on Pembroke Road. The officer investigating the break-in at Cole Gardens drove to Pembroke Road to talk to Osgood. Osgood allegedly said he was coming from the Steeplegate Mall. When asked what he was doing at the mall, Osgood allegedly said he was “looking for friends” and got something to eat at Burger King. When asked where he was before that, Osgood allegedly said he was at home at Iron Works Road. He allegedly denied knowing where Cole Gardens was.

“I have no reason for going all the way out there,” he allegedly stated.

The owner of the store was called to the scene and ID’d Osgood as the person that was at the store earlier in the morning, according to the affidavit. When the officer told Osgood he had been ID’d as the person at the store, he allegedly continued to deny that he was at the store. The officer reportedly analyzed Osgood’s sneakers and they allegedly matched footprints left at the scene.

The officer took a picture of Osgood and Osgood allegedly took off his sneakers and handed them to the police in an effort to prove that he was not involved in the break-in at the store. The officers then allowed Osgood to leave the scene on his bicycle, according to the affidavit.

Upon returning to the store, the officer spoke to the owner who reported that another broken window was found in the east side of the building. The owner stated that cash trays were inside a safe and the safe appeared intact. However, one drawer was missing from a terminal, with wires hanging out. The drawer was not found anywhere in the store.

Another officer arrived at the store to assist in gathering forensic evidence, walking the perimeter of the property, according to the report. That officer reportedly found a Verizon telephone but no cash drawer. He reportedly powered the phone up, in an attempt to find out who owned it. While checking the incoming text messages, one of the awaiting messages reportedly stated, “Kody where are you.”

The cell phone at the scene was enough to trigger an arrest warrant of Osgood and he was charged with one Class B felony count of burglary.

Osgood was arrested on May 1, and was allegedly in possession of a hypodermic needle, a piece of plastic with a red-maroon substance and a piece of glass with a dark colored residue at the time of his arrest. Police noted in the report that Osgood had track marks on both arms. He had a court date on May 1.
