Concord Man Allegedly Assaults Baby Girl

Scott Diberto faces first-, second-degree assault, other charges after investigation by police.

After a lengthy investigation, police have arrested a man on felony and other charges after allegedly assaulting a baby girl in an apartment on Ormond Street.

Scott Diberto, 25, of Concord, was arrested at 12:44 p.m. on Feb. 12, and charged with two counts of first degree assault, both felonies, second-degree assault, a felony, and two counts of endangering the welfare of a child or incompetent.

Diberto is being held on $200,000 cash bail and was arraigned on Feb. 13.

Limited information is available about the case due to most of the details being sealed by a Concord District Court judge, at the request of investigators and prosecutors.

An arrest report lists the victim as a 1-year-old girl and alleged that she was assaulted at around 4:15 p.m. on Jan. 26. Police seized a 2002 Chrysler Town & Country minivan as evidence. Investigators redacted, however, seven other pages of evidence in the report that were gathered for the case.

Witnesses who live in the apartment complex on the east side of the city said Diberto and the mother of the child moved into the apartment in January from Laconia. On Jan. 26, Concord Fire and Rescues teams were called to the apartment for a child that was injured. That child was later transported to Concord Hospital.

During the course of the week, detectives were at the apartment numerous times removing plastic garbage bags from the building.

Lt. Timothy O’Malley, the commander of the criminal investigations unit for the department, would not comment on the case on Jan. 31, when Patch confirmed detectives were at the apartment, or Feb. 14, due to the investigatory material being sealed.

City Prosecutor Tracy Connolly also confirmed the details of the case were closed due to it being “an ongoing investigation.”

Connolly would also not comment on the baby girl’s health, whether she was still in the hospital, with family, or any other details about the case. She said police had issued search warrants in the case and didn’t want anything about the case becoming public before a probable cause hearing on Feb. 27, and a trial management hearing on March 20. 

Arrest made in Laconia

After more than a week of investigating the case, Concord Police made an arrest on Feb. 12.

According to the arrest report, officers received information that Diberto might be in Laconia, staying with family members and an officer was sent there, to the area of Batchelder and Beaman streets around 12:30 p.m. to try and make an arrest.

About 10 minutes later, a Laconia detective who was assisting with the case, observed an elderly woman sitting on the front porch of an apartment building who might have been Diberto’s grandmother. The reporting officer stated that a young man in dark clothing then exited the apartment and began to walk from the area, according to the arrest report.

A short time later, Laconia Police made contact with the man and identified him as Diberto and he was arrested.

Back in Concord, Diberto reportedly signed a Follansbee form and spoke with an officer about the case for a short period of time, comments that were redacted from the report.

Diberto requested bail but was unable to come up with the $200,000 cash set by the commissioner. He was transported to the Merrimack County House of Correction and arraigned in court on Feb. 13.

A Google search yielded no information about whether or not Diberto had a criminal history.
