Wife Allegedly Assaults Husband with Swiffer Mop: Concord Cop Log

CONCORD, NH — Joshua Joseph Constant, 37, of Concord, was arrested at 1:23 a.m. on Dec. 8, 2012, and charged with driving while intoxicated and a bench warrant. While on patrol, an officer ran the plate of an Audi at the intersection of North Main and Pleasant streets. A report came back that the registered owner had an active bench warrant for failure to pay an attorney’s fees, with $205, cash to settle. The officer pulled behind the Audi and alleged that it made an illegal U-turn in front of The Draft on South Main Street. The officer pulled itover and spoke to the driver, Constant. “He was chewing gum as he spoke to me and his eyes were completely bloodshot,” the officer wrote, alleging that Constant’s car window was open, despite the very cold temperatures. Constant was taken into custody on the warrant. While in the cruiser, the officer alleged that the smell of alcohol emanating from Constant was very strong, adding that he was allegedly slurring his words. Constant refused to take a field sobriety test. He was later charged with driving while intoxicated and became “very defensive” after the charge. His wife came to pick up the vehicle. Constant was later released on $1,500 personal recognizance bail and was arraigned on Dec. 17, 2012.

Tonya M. Luba, 27, of Concord, was arrested at 5:20 p.m. on Dec. 21, 2012, on a driving after revocation or suspension charge. An officer was dispatched to the intersection of West and Glenn streets for a motor vehicle accident. One of the drivers, Luba, approached the officer and allegedly admitted that she did not have a license on her and believed that it was “not suspended anymore.” The officer checked and reported that the license was suspended in September 2011. Luba reportedly stated that she didn’t have the money to go to DMV to pick it up again. She was arrested and later released on $2,000 personal recognizance bail. She was arraigned on Jan. 28.

Michael Kay, 17, of Concord, was arrested at 2:30 a.m. on Dec. 21, 2012, on an unlawful possession of alcohol charge. An officer traveling west on Loudon Road reportedly witness two male subjects walking on the sidewalk near the Salisbury Green Apartments. Snow was falling outside when the officer pulled over to ask where the men where they were going. Kay reportedly told the officer they were heading to the 7-Eleven. The officer asked to speak with them and pulled over at the Hodges rental office at Loudon Road. The two men obliged. Kay reportedly told the officer that he was tagging along with his friend who was going to buy cigarettes. The officer alleged that while he spoke, there was “a strong odor of an alcohol beverage” on Kay’s breath. “I noticed his speech was slurred,” the officer added, but Kay allegedly denied drinking anything. Another officer arrived as Kay refused to take a PBT test. He was arrested and later released on $750 personal recognizance bail to his mother. Kay was arraigned on Jan. 28.

Craig Damato, 25, of Henniker, was arrested at 1:25 a.m. on Dec. 21, 2012, on two counts of driving while intoxicated. While driving near the roundabout at Franklin and North State streets, an officer allegedly saw a pickup truck drive over the curb and onto a sidewalk. The officer drove around the roundabout, followed the truck, and pulled it over at the intersectino of Centre and North State streets after allegedly seeing it cross over double yellow lines a number of times. Damato reportedly told the officer that he was dropping off a man and a woman who were passengers in his vehicle. “I noticed that his eyes were bloodshot and there was a very strong odor of alcohol coming from the vehicle,” the officer noted. After a field sobriety test, Damato was arrested. Both passengers left the scene on foot. He was later released on $1,000 personal recognizance bail and was arraigned on Jan. 7.

Thomas Burke, 29, of Concord, was arrested at 2:30 p.m. on Dec. 22, on a theft by unauthorized taking or transfer, a felony, due to two previous misdemeanor counts, from the Market Basket on Storrs Street. Police allege that Burke stole a Heineken beer valued at $3. Officers were dispatched to the store for a report of a theft but the man had left the store. Employees reported followed the man until the Bicentennial Square area where they lost track of the man. One officer saw a man matching the description on the stairwell near the School Street entrance of the Durgin Street Garage. The man allegedly left the area, walking up School Street. The officer pulled up beside him and “immediately recognized him to be Burke.” Burke allegedly became emotional and apologized to the officer for taking the beer. The beer can was left opened on the stairwell of the garage, the office alleged. Another officer at Market Basket watched video footage of the alleged theft and confirmed it was Burke. He was arrested, refused bail and was arraigned on Dec. 24, 2012.

Timothy J. Misiaszek, 20, of Windsor, was arrested at 1:09 a.m. on Dec. 22, 2012, on a bench warrant. An officer was traveling east on Franklin Street when he reportedly saw a 1988 Chevrolet pickup truck traveling west without a taillight. The officer turned around and caught up with the vehicle on Charles Street. According to the officer’s computer, Misiaszek had an electronic bench warrant out of Hillsboro District Court for an operating after suspension violation. He was arrested and later released on $30 personal recognizance bail.

Carl A. Hassum, 24, of Concord, was arrested at 1:31 a.m. on Dec. 22, 2012, on a driving while intoxicated charge. An officer was driving north on South Main Street and reportedly had to swerve to avoid a truck driving on Pleasant Street Extension. Later, as the officer caught up to the truck, he alleged that while turning onto South State Street, it failed to keep from crossing the yellow line. The officer pulled the truck over at the intersection of South State and Wall streets. While talking to the driver, Hassum, the officer alleged “a strong odor of alcohol” coming from inside the cab. The officer alleged that Hassum had problems responding to commands and delivering his license and registration. “While speaking with the driver I found his eyes to be glassy and his speech to be mumbled,” the officer wrote. After a field sobriety test, Hassum was arrested. He was later released on $2,000 recognizance bail and arraigned on Jan. 7.

Nicholas M. Archambault, 19, of Pembroke, was arrested at 8:45 p.m. on Dec. 23, 2012, on a criminal trespass charge at Walmart on Loudon Road on Nov. 27, 2012. The alleged victim in the case was a teenager from Pembroke. An officer picked up Archambault from the Pembroke Police Department at the Merrimack County Savings Bank parking lot on Manchester Street. He was later released on $2,000 personal recognizance bail and was arraigned on Jan. 20.

Julie M. Jewell, 38, of Auburn, Maine, was arrested at 9:05 p.m. on Dec. 24, 2012, on a criminal mischief (vandalism) charge from an alleged incident on Christian Avenue between Ormond and East Side Drive on Nov. 27, 2012. The alleged victim in the case was a Concord woman. The report noted that a rear windshield wiper was damaged on a 2003 Ford. An officer was dispatched to the Hannah Dustin Park & Ride in Boscawen to meet Franklin Police who had Jewell in custody. After taking custoday, en route to headquarters, Jewell reportedly complained of chest pains and having a hard time breathing. The officer had Concord and Fire rescue teams examine her and she was medically cleared. She was booked without incident and later, released on $2,000 personal recognizance bail. Jewell was arraigned on Jan. 28.

Amy Lynn Furmanick, 26, of Concord, was arrested at 3:04 a.m. on Dec. 24, and charged with simple assault (personal weapons), obstructing the report of a crime or injury, and criminal mischief (vandalism). An hour later, she was charged with three counts of possession of controlled drugs, all felonies. Officers were dispatched to Hammond Street for a domestic disturbance with a man reporting to dispatch that his girlfriend was “out of control and breaking things.” The man alleged that they were sitting on the couch together earlier when the woman, later identified as Furmanick, allegedly grabbed his arm and later, reportedly grabbed the phone out of his hand when he tried to call police. The man alleged that Furmanick broke the phone and the officer noted that the screen was cracked. The man alleged that there was a verbal dispute concerning unspecified issues. He also alleged that she smashed a lamp. The officer spoke to Furmanick and later, she was arrested. While performing an inventory of her purse at the police station, Suboxone, Dextroamphetamine, and Methylphenidate pills were allegedly found. None were reportedly found in a prescription bottle but were loose, in baggies, in the purse. Furmanick was later released on $3,000 personal recognizance and arraigned on Jan. 28.

Ryan Francis Smith, 25, of Concord, was arrested 9:05 on Jan. 2, on three counts of receiving stolen property charges. The charges stem from two alleged incidents at the Steeplegate Mall on Loudon Road on Nov. 16, 2012, Dec. 5, 2012, and another at the Naser Jewelers on Loudon Road on Oct. 10, 2012. The alleged victim in the case was his mother, a Concord woman. Two rings involved were valued at $850. An officer was contacted by the Claremont Police Department about Smith being held on an active warrant. Smith was later released on $4,000 personal recognizance bail and was arraigned on Feb. 4.

Jonathan Martin, 19, of Webster, received a summons at 9:16 a.m. on Jan. 2, for sale and distribution of tobacco products to minors, from Nov. 27, 2012, at Merrimack Valley High School. The alleged victim in the case was at a 14-year-old student. The case reportedly involved Skoal and Grizzly chew valued at $4. Martin was arrested by the school resource officer and had a court date on Feb. 4.

Derek J. Benwell, 25, of Concord, was arrested at 1:50 p.m. on Jan. 23, on three counts of theft by unauthorized taking or transfer, one of them a felony. The charges stem from alleged incidents on Dec. 11, 2012, and Dec. 13, 2012, at the Stratham Tire on Manchester Street. According to an arrest report, $5,585 in items, including tires, were taken from the location. An entry lock was also allegedly cut. An officer met with Franklin Police in Boscawen to take Benwell into custody. Personal recognizance bail was set at $10,000.

Raymond C. Ellsworth, 50, of Concord, was arrested at 2 p.m. on Feb. 8, on a duty to report charge from Jan. 22. An officer was sent to the state prison for a warrant service. Ellsworth refused bail and was arraigned on Feb. 11.

Bret Bamberger, 20, a homeless man now located in Concord, received a summons at 9:30 a.m. on Feb. 20, for an arrest warrant from Feb. 14, from the Nashua Police Department on a receiving stolen property charge. According to the report, an officer was sent Concord District Court because Bamberger and his attorney were reportedly there. After addressing other charges. Bamberger was taken into custody and transported to the Mall of New Hampshire in Manchester for an exchange with Nashua police.

Scott A. Fife, 55, of Boscawen, was arrested at 11:16 p.m. on Feb. 22, on a driving while intoxicated charge. Officers were dispatched to Stickney Avenue for a report of a Buick Regal off the road in a snow embankment. The officer reported smelling “a strong scent of alcoholic beverage coming from Fife’s breath” while talking to him. He was allegedly unable to answer basic questions about where he was coming from and what happened. Fife was later arrested and put into a police cruiser. An officer later allegedly found a Steel Reserve can of beer in the backseat of the car. At the police station, Fife reportedly had a difficult time keeping balance and butted his head into the cell bars. He allegedly refused to answer questions and reportedly scowled at the officer. He refused bail and was arraigned on Feb. 25.

Christopher R. Gennis, 32, of Concord, was arrested at 6:02 p.m. on Feb. 23, and charged with simple assault (personal weapons) and disorderly conduct. Officers were called to Garvins Falls Road at around 4 p.m. for a report that Gennis had cut himself with a knife but would not come out of his apartment. He later was assisted by officers and transported to Concord Hospital. About two hours later, officers were called to the hospital for a report of Gennis being “out of control and fighting with the staff.” When the officers arrived, security had him pinned down. He was later cuffed by officers. One of the nurses alleged that Gennis had struck twice with his fists while arguing with staffers about staying in the yellow pod area. Gennis was taken into custody and refused bail. He was arraigned on Feb. 25.

Brian E. Graves, 29, of Concord, was arrested at 6:10 p.m. on Feb. 25, on a conduct after an accident charge from Sept. 17, 2012, at the parking lot of the Walmart on Loudon Road. The accident reported involved a 1993 Chevrolet Suburban and a 2003 Mitsubishi Montero. The alleged victim was a Bedford woman who was a stranger to Graves. According to the report, Graves’ wife allegedly advised him to leave the scene of the accident. Graves was released on $1,000 personal recognizance bail and has a court date on March 25.

Shane D. Plummer, 28, a homeless man now located in Concord, was arrested at 4 p.m. on Feb. 26, on a willful concealment charge. According to an arrest report, an officer was sent to Sears at the Steeplegate Mall for a report of a shoplifting suspect that allegedly got away from loss prevention employees with a stolen Play Station 3 controller and was now heading towards the Starbucks on Loudon Road. Upon arriving at the scene, the officer reportedly saw a man matching the description who, when seeing the police cruiser approach, allegedly reversed direction away from the officer. The officer caught up with the man, later identified as Plummer, and spoke to him. The officer alleged that Plummer was “breathing heavily” and stated he was meeting a friend at Starbucks. While talking with the officer, Plummer allegedly became upset and attempted to walk away from the officer, heading towards a port-a-potty. The officer reportedly grabbed him by the jacket. Plummer allegedly said he was going to throw up and the officer told him to do so in the snow, something he reportedly never did do. During questioning, Plummer denied being at the Mall or Sears even though, while pulling out his ID, a receipt from another store at the Mall was with his ID. He allegedly stated that he was being chased by someone so he ran from the scene. Later, the loss prevention officer arrived at the scene and all headed back to Sears to examine surveillance video. Plummer was later arrested and charged. He was released on $1,000 personal recognizance bail and is due in court on April 1. The controller was valued at $54.99.
