ARRESTS: Pembroke Teen Accused of Theft from Walmart

The following information was supplied by the Concord Police Department. It does not indicate a conviction.

  • Benjamin H. Valk, 26, of Penacook, was arrested at 4:48 p.m. on Dec. 5, 2012, on a simple assault (personal weapons) charge. According to an arrest report, three officers were called to Modena Drive for a 911 call and an unknown problem. A dispatcher reported that the call was “very muffled” and the male caller would not answer why the police were needed. As the officers arrived, near Canoe Street, they reportedly could hear two men yelling at each other with one allegedly demanding that the other get off him. One officer observed a group of people near the mailboxes near Bluff Drive, and allegedly saw Valk on top of another man who later turned out to be his brother. The officer alleged that Valk had his arm on his brother’s jaw, “pinning him to the ground.” The officers ordered Valk to get off the man but he refused and officers allegedly had to pull him off the other man. He was later put into handcuffs for safety reasons, according to the report. Later, Valk was cooperative during the interaction with officers. Another officer reported seeing a small cut on the brother’s cheek. In the process of talking to the two men, it was revealed that the brother was ordered by his mother not to leave their home because he was grounded and Valk was allegedly attempting to keep him from leaving the home. The two allegedly started fighting as the younger brother left the home, with Valk believing that he was running away. Witnesses were spoken to and those statements reportedly confirmed Valk’s side of the story. Valk was arrested and later released on $2,000 personal recognizance bail.
  • Jerry Arthur Dupont, 47, of Epsom, was arrested at 12:49 a.m. on Dec. 11, 2012, on two counts of driving while intoxicated and aggravated driving while intoxicated. According to an arrest report, an officer was traveling on Loudon Road near TGI Fridays when a 1999 Chevrolet pickup truck quickly exited the restaurant’s parking lot requiring the officer to make a quick stop before hitting the truck. The officer alleged that the truck crossed over the dashed white lines “a number of times,” swerving back and forth between travel lanes. The truck appeared to have a difficult time staying in marked lanes, according to the officer. The truck was pulled over at the Walmart on Loudon Road. The officer reported that while approaching the vehicle, there was overwhelming smell of alcohol emanating from the truck. “I could not understand him because his speech was slurred and slow,” the officer alleged. Dupont also allegedly had problems getting his license out of his wallet and couldn’t find his truck registration. He was later arrested. Personal recognizance bail was set at $5,000 and Dupont was arraigned on Dec. 31, 2012. He was also issued two summonses for driving infractions.
  • Kenneth Lewis, 18, of Pembroke, was arrested at 4:51 p.m. on Dec. 12, 2012, on a theft by deception charge. The charge stems from an alleged incident at Walmart on Nov. 26, 2012, involving a Walmart gift card, men’s socks, and overall pants, all valued at about $120. An officer was sent to Merrimack County pre-trial hearing to issue a warrant to Lewis concerning the alleged theft. He was released on $2,000 personal recognizance bail and had a court date on Jan. 14.
  • David Scott MacAllister, 54, of Barrington, was arrested at 6:41 p.m. on Dec. 17, 2012, and charged with conspiracy to commit, burglary, a felony, and two counts of theft by unauthorized taking or transfer, one of them a felony. The burglary charge stems from an alleged incident on May 26, 2012, at the Summer Freeze at Fisherville Road. A theft charge was allegedly about $200 worth of items on May 27, at Walmart on Loudon Road. A donation can with $10 in it was allegedly stolen from the Circle K/Irving on Loudon Road. An officer was dispatched to headquarters around 6 p.m. to meet with MacAllister who was turning himself in on a number of warrants. Personal recognizance bail was set at $12,000. He was arraigned on Jan. 14.
  • Richard Eaton, 29, of Concord, was arrested at 9:06 a.m. on Dec. 28, 2012, on two theft charges, from the Cumberland Farms on Nov. 14, 2012. Police allege that Eaton stole two bottles of Wild Irish red wine valued at around $10. According to an arrest report, an officer reported to the state hospital to arrest Eaton, who resides there. He was released on $1,000 personal recognizance bail and had a court date on Jan. 28.
  • Gavin R. Guay, 21, of Concord, was arrested at 9:58 a.m. on Dec. 28, 2012, on a criminal mischief (vandalism) charge. According to an arrest report, two officers were called to Pleasant Street for a domestic disturbance between a mother and her son. The mother told police that she had been attempting to arouse her son, Guay, who is out of work, to start his day by 9 a.m., encouraging him to keep a schedule and look for employment every day. The mother alleged that Guay got up at 9 but later went back to bed. She called him on his cell phone and he allegedly said he was cleaning his room. A short time later, after talking to him on the phone a second time, she went to check on him in his room and he allegedly was holding the door so she couldn’t get in. The mother continued to try and gain access to the room while Guay allegedly held the door. Later, he allegedly “got upset and became out of control” about the situation. Guay then allegedly kicked a mirror that was hanging on the wall and the mother called 911. The officer spoke to Guay who allegedly admitted to the argument but said he didn’t break the mirror on purpose. After more discussion about the matter, Guay was arrested. He was later released on $2,000 personal recognizance bail and had a court date on Jan. 28.
  • Brenda Rose Demary, 61, of Concord, was arrested at 10:28 a.m. on Dec. 28, 2012, on a theft by unauthorized taking or transfer charge. According to an arrest report, on Dec. 7, around 2 p.m., Demary allegedly stole two snow globes, two 16-packs of AA batteries, a 4-pack of D batteries, and some socks from a local store. The value of the items was around $96. She turned herself into police on Dec. 28. She was released on $2,000 personal recognizance bail and had a court date on Jan. 28.
