According to an arrest report, an officer was on foot patrol in the area of the Morning Star Apartments on Loudon Road and saw four people walking in the parking lot with one carrying a case of beer and actively consuming from an open container. The four stopped at a vehicle and were hanging around.

The officer approached the two men and two women and when one of the women realized it was a police officer, she put down the open beer on the trunk of the vehicle. Another man who was sitting in the passenger’s seat of the vehicle was holding some folded tinfoil in his hand, according to the officer, who reported that the man “made some furtive movements with this hands to conceal the items that he was holding.”

The officer asked for identification and alleged that the man placed the tinfoil under his rear-end. The officer called for backup and asked the man to step away from the car and drop the tinfoil on the seat and he reportedly complied.

The officer began questioning the man, Rebholz, a woman at the scene, Barreto, and two other individuals. Rebholz allegedly “began to become emotional and started to cry while we were asking him questions,” according to the report.

“During questioning, he told us that we would find heroin residue in the tinfoil,” the officer alleged.

The officer grilled Rebholz about whether or not he was planning on selling or using the heroin with Barreto and he allegedly denied he was. He reportedly gave consent to search the vehicle and police allegedly found numerous packages of Suboxone, in film form, inside a pack of Newport cigarettes. Inside a second pack, an officer allegedly found marijuana, two pills (Hydroxyzine), a smoking device, and a small amount of what looked like crack cocaine.

Rebholz allegedly stated that the crack was actually sheet rock.

“He then told me that he bought it in Manchester, thinking it was heroin,” the officer alleged. “He said he been ripped off. When I asked him why he still had it, he did not have an answer.”

Rebholz reportedly denied having a prescription for the drugs and the vehicle was immediately impounded. He was arrested and charged.

The other man and woman, including the one drinking the open container, were released from the scene, according to the report, while Barreto was arrested on the warrant.
