Four Arrested at Underage House Party

Complaints about noise and fighting in an apartment on Fisherville Road landed a number of young men in trouble with the law last month.

Matthew Lawrence Finethy, 19, of Center Barnstead, was arrested at 5:49 a.m. and charged with simple assault (personal weapons) against a police officer and unlawful possession of alcohol. 

John Leone, 18, of Barnstead, was arrested at 6:14 a.m. on an unlawful possession of alcohol charge.

Brenden Colby, 18, of Center Barnstead, was arrested at 6:38 a.m. and charged with simple assault (personal weapons) against a police officer, resisting arrest or detention, and unlawful possession of alcohol. 

At 6:42 a.m., Justin Philip Fostier, 22, of Concord, was arrested on a facilitating a drug or underage alcohol house party. Two others were taken into custody and released to their parents.

According to a number of arrest reports, officers were called to an apartment on 86 Fisherville Road for loud noises and banging in an apartment since around 2:30 a.m., including a possible fight.

When the officers arrived, they couldn’t hear any noise from the apartment in question. After several attempts trying to get someone to answer the door, Fostier answered, according to police. Fostier reportedly told police he lived at the apartment with a female roommate who was not currently home.

Fostier was questioned about a possible fight or a party going on at the apartment and he allegedly confirmed there were others in the home and allowed police to enter the apartment.

“Inside the residence, I observed numerous beer cans, beer bottles, and various glass bottles which I recognized as alcoholic beverages scattered around the apartment,” the reporting officer alleged. “The floor of the apartment, in some areas, was covered with beer cans.”

The officer also reported seeing “numerous” ping-pong balls and plastic cups on tables. The officer also saw two men and asked whether there were others. Fostier reportedly said no but then, the officer saw three people in a room passed out, including Finethy, Colby, and another teen.

The officer questioned Fostier about people in the apartment and “was hesitant and could not provide (the officer) with a clear answer” about who was in the apartment.

An officer tried to wake Finethy, who he recognized from a previous arrest in December 2013, but couldn’t. He then tapped his leg that reportedly startled him and he “immediately fell off the bed and onto the floor.” The officer attempted to help him up but “it was clear that Finethy was intoxicated” and “was extremely unsteady on his feet.” He later allegedly “became increasingly aggressive in nature” and shoved an officer and he was arrested, after a brief struggle.

Other officers arrived to assist in removing Finethy who allegedly “remained uncooperative” and “was dragging his feet” as officers tried to remove him. They later had to carry him out, according to the report.

Fostier allegedly “claimed full responsibility for the incident” since it was his apartment. He was arrested and had a court date on April 7.

During processing, Colby was allegedly given a cellphone to arrange a ride but when there were signal problems, allegedly “became argumentative” and verbally abusive. When asked to move to another cell, he allegedly refused, and resisted, clinching his fists, and later, spat at an officer.
