CRIME LOG: Traveling the Wrong Way on a One Way Leads to DWI Arrest

The Concord Police Department supplied the following information. It does not indicate a conviction.

Michael N. Merritz, 24, of Concord, was arrested at 11:45 a.m. on May 22, and charged with possession of drugs and possession of controlled drugs. While on Downing Street an officer observed a 2010 Kia Soul with expired inspection and registration stickers parked on the street. The officer approached as the driver, Merritz, reportedly was getting out of the car. Merritz reportedly told the officer that due to “a lack of money” he wasn’t able to register or inspect the car. “While speaking with Michael, with his driver’s door open, I observed a glass pipe, which appeared to be dirty as it had recently been used,” the officer alleged. The officer smelled the pipe and alleged it was marijuana. Merritz was arrested and was arraigned on June 30. He was also cited for unregistered vehicle.

Dustin Patrick Averill, 20, a homeless man now located in Concord, arrested at 6:58 p.m. on May 22, on a felony bench warrant. While on patrol on Loudon Road, an officer saw Averill walking near the Everett Arena. The officer checked and found that Averill had a bench warrant and capias out of Merrimack Superior Court. The officer radioed for backup and picked him up on the bridge. Averill allegedly told the officer that he had just taken a shot of heroin during the last hour, injecting himself in the bathroom of the McDonald’s Restaurant on Loudon Road. He was taken in to custody and handed over to a sheriff’s deputy.

Cory Kelleher, 20, of Concord, was arrested at 9 p.m. on May 22, on a simple assault charge. Police were sent to Thompson Street for a welfare check around 7 p.m. about a possible domestic between a couple. Officers spoke to Kelleher who allegedly stated that the two were arguing about feeding their daughter and he pulled on his wife’s sweater during the argument. The couple later agreed to leave the home but officers stayed around to talk to witnesses at the scene. One alleged hearing the couple arguing and then a loud bang. The couple both returned downstairs where, the witness alleged, Kelleher “grabbed (his wife) by the upper arm and yanked her outside, causing her to almost fall to the ground.” The two continued to argue, according to the witness. Another witness shared a similar story about the incident. The reporting officer then went to the Olive Garden Restaurant to speak with the couple about the incident. The woman reportedly admitted that Kelleher “kicked a wooden bedframe out of anger, which caused the noise,” and later stated that Kelleher had allegedly grabbed her. He was arrested and had a court date on June 30.

Kyle Wallace, 21, of Concord, was arrested at 1:10 a.m. on May 23, and charged with suspended registration, driving after revocation or suspension, and driving without giving proof. An officer spotted a 2001 Toyota coupe with a driver’s side brake light that wasn’t functioning on North Main Street and stopped the vehicle on South Main at Hills Avenue. Dispatch advised that the driver, Wallace, lost his driving privileges for lack of insurance on April 13, and he was arrested. He was arraigned on June 30.

Brian P. Quinn, 26, of Concord, received a summons at 8:53 a.m. on May 23, for reckless operation. An officer was sent to Loudon Road to check on a complaint of a yellow Jeep reckless passing other vehicles on the sidewalk. The officer realized that there was a yellow Jeep with a loud radio playing at the intersection of Loudon Road and Canterbury Road a few minutes before and turned around to try and find the vehicle. The officer caught up with the Jeep in the parking lot of the Windmill Family Restaurant and spoke to the driver, later identified as Quinn. “Quinn started to get defensive and asked what this was about,” the officer alleged, “(and) only got more frustrated and immediately denied he was in the area of Fort Eddy Road.” The officer alleged that Quinn became more upset and angry when she tried to discuss the complaint raised about his driving. After issuing a summons to Quinn, the officer spoke to the witness who described the situation and agreed to appear in court about the incident. Quinn was arraigned on June 30.

Tammy Sweatt, 46, of Weare, was arrested at 12:30 p.m. on May 23, on three counts of issuing bad checks from November 2013, at the Kinko’s Copies on Fort Eddy Road, and four counts of issuing bad checks from December 2013, at the Concord Food Co-op on South Main Street. She turned herself in to police and had a court date on June 30.

Ian A. Murray, 21, of Concord, was arrested a 2:28 p.m. on May 23, on a criminal mischief charge from an apartment on Church Street on May 15. He was extradited from the Aroostock County Jail in Maine on the charge. Murray was arraigned on June 30.

Samantha Loeser, 17, of Salisbury, was arrested at 3:45 p.m. on May 23, on a possession of drugs charge from May 8, at Merrimack Valley High School. She turned herself in to police, was released on $2,000 personal recognizance bail, and is due in court on July 7.

Cody White, 21, of Hopkinton, was arrested at 1:51 a.m. on May 24, on two driving while intoxicated charges. An officer drove onto School Street from North Main and observed a Volkswagen GTI pull out of the Durgin Block Garage,  driving east going the wrong way on a one-way street. “The vehicle was traveling faster than most cars coming out of the garage and did not stop or slow down as it exited the garage,” the officer alleged, “causing the vehicle to make a wide turn onto School Street.” The officer pulled over and activated the cruiser’s lights. White reportedly told the officer that the passenger in his car told him to take a right. The officer alleged that while talking to him, White smelled like alcohol. The officer requested he step out of the vehicle to perform field sobriety tests and he was later arrested. White was arraigned on June. 9.

Brittany K. Ashton, 28, of Concord, was arrested at 6:02 a.m. on May 24, on two bench warrants out of Concord District Court for tampering with public records on April 16, and bail jumping on May 8. While on patrol on Hall Street, an officer saw a person going through a vehicle and investigated the situation. The woman, Ashton, owned the vehicle she was going through but had active warrants and was arrested. She’s due in court on July 7.

Benjamin M. Berry, 37, a homeless man now located in Concord, was arrested at 11:14 a.m. on May 25, and charged with felony theft by unauthorized taking or transfer from April 10, at the New Hampshire Liquor Store on Storrs Street, and for consumption of liquor on private property on Storrs Street. An employee of the Market Basket on Storrs Street filed a complaint about a panhandler who left before the officer arrived. The man, later identified as Berry, headed south toward the train tracks. The officer headed over to the former liquor warehouse and encountered Berry allegedly consuming vodka from an open 1.75 liter bottle. A check of Berry yielded a theft warrant and he was arrested. Berry is due in court on July 7.

Jami Longo, 27, of Tamworth, received a summons at 5:37 p.m. on May 25, for driving after revocation or suspension. She received the summons after an accident at Loudon Road and Sheep Davis Road. A check of Longo revealed that her license was suspended for default child support on May 13. She had a court date on June 30.

Tracy Silva, 40, of Concord, was arrested at 8:04 p.m. on May 25, on a simple assault charge. Police were sent to Canton Circle for a domestic disturbance for a woman alleging that her fiancée’s mother had assaulted her. During the fight, the woman alleged that after deciding to move out of the house, Silva “put both of her hands on her shoulders and shoved her back into the closet.” A man attempted to get between the two of them and Silva allegedly grabbed the woman’s arms and scratched them. An officer spoke to a witness who allegedly heard screaming and went to the home to see what was going on and saw the women fighting and screaming. Silva allegedly denied touching the other woman but the officer noticed she had long fingernails and based on the other statements, arrested her. She was arraigned on June 30.

Joshua Dennis Taylor, 42, of Concord, was arrested at 11:56 p.m. on May 25, on a resisting arrest or detention charge. Officers were sent to the Vegas Block Apartments on North Main Street and saw two individuals loitering in front of the building with large backpacks. The officer pulled around to speak to the individuals and as he did that, the two men separated and began to leave the scene. One, Taylor, headed toward Dixon Avenue where the officer ordered him to stop and get on the ground but he allegedly refused. Later, he was taken to the ground, and arrested. Taylor was held until he was sober and is due in court on July 7.
