ARRESTS: Concord Man Faces Gun Charge

The following information was supplied by the Concord Police Department. It does not indicate a conviction.

Benjamin M. Berry, 37, a homeless man now located in Concord, received a summons at 11:30 a.m. on Jan. 31, for the passing of items to or from a motor vehicle on a roadway, an ordinance violation. While in the parking lot of L.L. Bean, an officer reportedly saw a panhandler in the Fort Eddy Road Plaza receiving items from a person in a vehicle. The man walked into the street, took an item from the vehicle, and then returned to the median. Other vehicles were honking at the vehicle giving out the item and the man. While doing this, another vehicle pulled to the right to pass the stopped vehicle, according to the officer. “This action almost caused an accident and caused drivers to yell at each other,” the officer alleged. The officer spoke with Berry who reportedly said he hadn’t been warned about not stepping into the roadway. However, a check revealed a warning issued to Berry on May 28, 2013, so he was issued a summons.

Todd Michael Horstkotte, 42, a homeless man located in Concord, was arrested at 11:40 a.m. on Feb. 4, and charged with bail jumping, criminal trespass, and three bench warrants. An officer reportedly saw Horstkotte panhandling in the Fort Eddy Plaza shopping center and ran a check on him and found out that he was wanted on warrants. One of the warrants was a bail jumping charge for allegedly failing to appear in court on Jan. 27, on a criminal trespass charge from Dec. 13, 2013. He was also given a no trespass order to the property on Dec. 2, 2013. Horstkotte was arrested and held without bail.

William Mills, 43, a homeless man now located in Concord, was arrested at 3:30 p.m. on Feb. 5, on a default or breach of bail conditions charge. Concord Fire and Rescue teams were called to the railroad tacks behind the Concord Center on Ferry Street for a man down, later identified as Mills. Police made contact with Mills and reported he was intoxicated, not injured. Mills was out on bail and a condition of his bail was to not drink. “Mills stated he only had three beers,” the officer reported, “but he was clearly drunk.” He was arrested and held without bail.

Lauren E. Dickson, 32, of Bow, was arrested at 1:52 a.m. on Feb. 7, on a disorderly conduct charge. An officer was called to assist the parking enforcement officer with a case where a woman had reportedly gotten into her car while it was being towed. The officer found the woman, Dickson, inside her 2005 Hyundai Elantra as it was halfway up the tow truck bed. When asked to get out of the car, Dickson allegedly stated, “No,” and reportedly didn’t move on subsequent requests. When told she would be arrested if she didn’t get out of the car, Dickson allegedly started the car’s engine and “fully pressed the accelerator, causing the front tires to spin.” The officer then demanded Dickson get out of the car and she allegedly yelled, “You’re only doing this because I’m poor.” The officer reported that Dickson’s sister began yelling at her, telling her to get out of the car. The officer began to make entry into the vehicle and she reportedly unlocked the door and was taken out of the vehicle. The officer alleged that she was wearing a T-shirt, unbuttoned jeans, and nothing on her feet. She was arrested and held without bail.

Kenneth M. Smith, 42, of Concord, was arrested at 12:51 p.m. on Feb. 7, on a default or breach of bail conditions charge. Officers were called to Elm Street in Penacook for a past tense domestic that occurred on Village Street where the victim, a woman, had fled the apartment and called police. The woman alleged that Smith “had been yelling and throwing things at her.” The problems started the previous evening but she didn’t call police until the daytime. The officer noted there had been previous incidents between the couple, most recently in November 2013, when Smith was arrested on a simple assault charge. Bail conditions, according to the watch commander, required a police escort for Smith to be at the Village Street apartment. Police went to the apartment but there was no response. The woman later arrived with a key and let police in. Smith then allegedly appeared and was asked if he was supposed to be in the apartment. He allegedly stated that he wasn’t and was arrested.

Jeffrey A. Beecher, 26, of Concord, was arrested at 12:33 a.m. on Feb. 8, on a carrying a loaded handgun without a license charge. An officer near North Main Street and Loudon Road reported that a 1999 Jeep Grand Cherokee with a temporary plate was driving north on North Main Street and appeared to be speeding. The officer accelerated to about 50 mph to catch up to the vehicle which then pulled away from the officer, driving faster, according to the report. The officer reported having to get up to 70 mph to catch up to the Jeep near Franklin Street. “I then noticed the vehicle weaving in a lane,” the officer reported, and the Jeep was pulled over. While initiating the stop, the officer alleged that the Jeep’s brake lights weren’t working. The Jeep stopped at the intersection with I-393 and the officer alleged that it was revving its engine while he got out of the cruiser, so backup was called. The officer spoke to Beecher who reportedly stated that the Jeep was giving him problems and it was speeding because of a stuck accelerator. Other officers arrived while the original officer did a background check on Beecher. One began speaking to Beecher about a fugitive gun program and Beecher reportedly told the officer he had a Ruger .45 caliber semi-automatic handgun on his hip under his jacket. Beecher, however, didn’t have a concealed carry permit but had reportedly applied for one. The firearm, which was loaded with nine rounds and had a bullet in the chamber, was allegedly taken from Beecher and he was arrested. “Beecher became upset stating the person at the gun store told him he could do that, and he did not realize what he was doing was a crime,” according to the report. He’s due in court on March 10. He was also cited for speeding.

Joshua James Albert, 33, a homeless man now located in Concord, was arrested at 9:32 a.m. on Feb. 9, on two bench warrants. While traveling on Manchester Street, an officer spotted Albert and knew him from previous contacts. He ran a check on him to see if he had an active warrants and two came up – one from Nov. 26, 2013, out of Candia District Court for nonappearance in court on a driving after revocation/suspension charge, with $250 cash to settle. The other was from Dec. 17, 2013, out of Concord District Court, for nonappearance in court on a criminal trespass charge. Albert was arrested outside of the Dunkin’ Donuts and held without bail.

Kevin Michael Burke, 37, of Manchester, was arrested at 8:15 p.m. on Feb. 10, on a driving after revocation or suspension charge. An officer driving on Bog Road heading to another call encountered a white GMC van driving at a high rate of speed and swerving over the solid yellow center line. The officer had to move out of the van’s way in order to avoid a collision, according to the report. The officer turned around and pursued the van but couldn’t find it and thought maybe it had turned onto a side road. The officer reversed direction in the parking lot of the Lun Hing Motel on Fisherville Road and pulled back onto Fisherville. While doing that, the van pulled up to the intersection from Bog Road. The van was pulled over near Rex Drive. A check of the driver, Burke, revealed that his license was suspended on July 21, 2013, and had previously been convicted of driving after suspension in January 2008. During interaction with the officer, Burke allegedly said he had an active license and then later admitted he knew he had a suspended license. He’s due in court on March 10.

Tabitha G. Chenoweth, 41, of Concord, was arrested at 4:20 p.m. on Feb. 10, on two disorderly conduct charges. The charges stem from alleged incidents at Concord High School on Jan. 28. She turned herself in to police and is due in court on March 24.

Mark A. Corente, 38, of Tilton, was arrested at 12:52 p.m. on Feb. 10, and charged with possession of controlled drugs, a felony, and possession of drugs. The charges stem from an alleged incident on South Main and Storrs streets on July 23, which included an unknown drug type and a black pouch with three spoons. Corente turned himself in to police and had a court date on March 3.

Carl Alford Fumerelle, 46, a homeless man now located in Concord, was arrested at 2:45 p.m. on Feb. 10, on warrant. An officer was at the Subway on North Main Street and saw Fumerelle and knew he had an active warrant out of Manchester and he was arrested. Manchester Police then came to pick him up.
