ARRESTS: Man Allegedly Steals MD 20/20 at Cumbies, Assaults Cops

The Concord Police Department supplied the following information. It does not indicate a conviction.

Susan Marie Marston, 49, of Concord, was arrested at 9:49 a.m. on June 3, 2014, on a criminal trespass charge. While on bike patrol, officers saw a woman on the railroad tracks near The Friendly Kitchen, sitting on a sleeping bag underneath a tree. A check of the woman, Marston, revealed numerous charges and warnings about being on the railroad tracks. “I told her she was on private property and she said, ‘F--- you,’” the officer alleged, adding that she said the officer was “an a--hole” and harassing her. Marston was arrested and is due in court on July 14.

Jason Edward Brooks, 35, of Concord, was arrested at 10:29 a.m. on June 3, and charged with two counts of fraudulent use of a credit card, receiving stolen property, and two bench warrants. An officer was sent to Concord District Court to arrest Brooks on warrants, one out of Concord from April 14, and another out of Dover District Court on May 20, with $1,485, cash to settle. He had a court date on July 9.

Melissa F. Kukla, 19, of Concord, was arrested at 10:10 p.m. on June 3, and charged with possession of drugs, possession of controlled drugs, and transportation of alcoholic beverages by a minor. While running radar on North Main Street, an officer clocked a Honda Civic driving 45 mph in a 30 zone. The car was stopped at Loudon Road. As the officer walked to the car, she allegedly saw a box of Bud Light Lime beers partially hidden by a jacket. She spoke to the driver, Kukla, and a male passenger. Kukla denied that the beer was hers and the officer noted that she didn’t smell like alcohol and didn’t appear to be impaired. A crushed beer can was found on the floor of the front seat as well as a bag of empty beer cans. The man, who was 21, said he didn’t want to leave the empties at the park. After some discussion, Kukla was arrested. An inventory of the vehicle later allegedly revealed a small digital scale, grinder, glass pipe found inside of a purse on the floor, and marijuana was found in the grinder, so the drug charges were added. She was also cited for speeding. Kukla is due in court on July 14.

Elizabeth S. Patten, 54, of Chichester, was arrested at 5:38 p.m. on June 3, on a conduct after an accident charge from May 23, at the Sam’s Club on Sheep Davis Road. She turned herself in and had a court date on July 7.

Kayla Joanne Fife, 23, of Warner, was arrested at 11:40 a.m. on June 4, on a default or breach of bail conditions charge from April 21, on Village Street in Penacook. Fife turned herself in and is due in court on July 14.

Alexander S. Papastefanou, 30, a homeless man now located in Chichester, was arrested at 1:50 p.m. on June 4, and was charged with three felony receiving stolen property charges, two felony theft by deception charges, and two warrants. Amber Lee Griffith, 28, of Concord, was arrested at 1:52 p.m. on June 4, on a bench warrant. Officers were called to Maple Street for a domestic disturbance. When officers arrived, they spoke to Griffith who reportedly stated that she was pregnant and overdue, and got into a verbal argument with Papastefanou. Both Griffith and Papastefanou had active warrants so they were arrested. Griffith was wanted for nonappearance in Hooksett District Court on an operating after suspension charge issued on April 4. She had a court date on June 25. The charges against Papastefanou stemmed from alleged incidents in November 2013 at The Jewelers Workbench at the Steeplegate Mall and A Jewelers Workshop on South Main Street. According to a court affidavit, officers were called to a home on Washington Street that had been burglarized. The victim reported a missing wedding ring with a specific description on it. A witness reported that a white man was seen in the area around the time of the break-in. Later, The Jewelers Workbench reported that the ring was on a list of items that were allegedly hocked the ring for $420. In December 2013, police found other items that Papastefanou allegedly sold. The warrants were from the Merrimack County Sheriff’s Department for a theft charge and a nonappearance in court charge on a theft charge. Papastefanou refused bail and was arraigned on June 5.

Elliott Steven Dafoe, 30, a homeless man now located in Concord, was arrested at 10:30 p.m. on June 4, and charged with felony theft by unauthorized taking or transfer, two counts of simple assault, criminal trespass, and resisting arrest. According to an arrest report and court affidavit, officers were sent to the Cumberland Farms on North Main Street for a problem with panhandlers. One officer spoke with two individuals near a dumpster while another officer spoke with Dafoe. The officer speaking with Dafoe reportedly saw a bottle of MD 20/20 in his pocket and took it out while another officer went to speak with a clerk. The clerk alleged that Dafoe a stole the MD 20/20, valued at $5.99. Dafoe had been told on April 15, that he was not allowed on the premises, and was arrested. During the process of the arrest, Dafoe was told to take off his backpack but allegedly shook his head back and forth, and became angry, tensing up his body, and refusing to obey verbal commands. Dafoe allegedly took out his sleeping mat and “whipped the mat” at one of the officers. As one of the officers stepped toward Dafoe to restrain him, he allegedly grabbed the officer by the neck. The officer was able to get loose and two of them took Dafoe down to the ground. After he was cuffed, Dafoe allegedly kicked one of the officers in the thigh and was held on the ground until he calmed down. Previously, Dafoe was convicted of willful concealment in October 2011 and receiving stolen property in March 2012, so the theft charge was elevated to a felony. He was held on $8,000 cash bail.

Jamie G. Lucier, 30, of Concord, was arrested at 12:54 a.m. on June 5, and charged with theft by unauthorized taking or transfer, default or breach of bail conditions, and three bench warrants. The theft charges stem from an alleged incident at the 7-Eleven on Loudon Road on Dec. 18, 2013, involving the theft of a $100 remote control helicopter, according to a court affidavit. An officer on foot patrol near the Morning Star Apartment complex came across a man riding a child’s bicycle in a wooded area of the complex. The officer spoke to the man who allegedly stated it was his nephew’s bike. The man gave a name to the officer but the name did not come back on file. The man gave a date of birth but that came back to someone with different descriptors. The officer then matched a tattooed name on the man with the birth date and found out it was Lucier, who had multiple warrants and was arrested. Lucier was held on $1,000 cash bail and arraigned later that morning. Lucier’s mother later told police that the bike was Lucier’s son’s bike, according to the report, and didn’t know if it was stolen or not.

William Mills, 44, a homeless man now located in Concord, was arrested at 2:04 p.m. on June 5, on a possession of controlled drugs charge. Officers were sent to the Day’s Inn on South Main Street for a report that Mills had rented a room for the night before and paid for it, but had allegedly not paid for the next day and wouldn’t leave. The officers went to the room where Mills was staying with others. One of the officers allegedly saw a glass smoking device with burnt marijuana on it. The other guests denied it was their bong. Mills allegedly appeared “very intoxicated” and “had a hard time speaking and was swaying side to side” and since the room was rented to him, was arrested. Later, an officer allegedly found a bag of marijuana in his front pants pocket. Mills is due in court on July 14.

Devin Aaron Baillie, 36, of Concord, was arrested at 8:43 p.m. on June 5, on a disorderly conduct charge from May 25, at an apartment on Maple Street. An officer was on North Main near Franklin when he noticed Baillie walking on the sidewalk and knew he had an active warrant. The officer pulled over to the Concord Mart and spoke with Baillie who allegedly “had slurred speech and he was unsteady on his feet.” He was arrested on the warrant and has a court date scheduled for July 14.
