Gov. Lynch Vetoes Voter ID Bill

He also vetoes medical marijuana bill and two others.

 

Gov. John Lynch on Thursday vetoed the Voter ID bill passed by the House and Senate earlier this year.

"The right to vote is a fundamental right that is guaranteed to all citizens of this State under the United States and New Hampshire Constitutions," Lynch said in his veto message. "Our election laws must be designed to encourage and facilitate voting by all eligible voters in New Hampshire."

SB 289 would have required voters to present valid photo identification or execute an affadavit in order to vote in person in a municipal, state and federal election beginning with this September's primary. Under the final version of the bill, acceptable forms of photo identification for this year's elections would have included a driver's license from any state, a non-driver's ID card, a U.S. armed forces ID card, a U.S. passport, any other valid photo ID issued by federal, state, county or municipal government, a valid student identification, and any other photo identification deemed to be legitimate by election officials.

Lynch, a Democrat, said he was prepared to support this form of photo ID because it "would ensure that every eligible voter who went to the polls on Election Day was able to cast a ballot that would be counted." But he said the Legislature adopted a more restrictive list of valid photo identifications to be used in elections beginning in Sept. of 2013, which he said is "far more restrictive than necessary."

He also objected to language in the final version of the bill that required voters who lack photo ID to execute a voter affadavit, which he said should only be required for those not already registered to vote.

"It is completely inappropriate for use by a registered voter on Election Day in order to establish the voter's identity to vote," Lynch said.

House Speaker William O'Brien and House Majority Leader Peter Silva issued a statement this afternoon decrying Lynch's veto of the Voter ID bill.

"The vast majority of New Hampshire voters will be disappointed to learn that in one of his last acts on legislation, this Governor has chosen to favor his party’s discrimination mythology about voters being asked for photo identification instead of supporting a common sense solution to the pressing need to ensure honest elections," O'Brien, R-Mont Vernon said. He called the Voter ID bill "a well-structured approach to ensuring clean elections," and called on all candidates for governor to take a position in support of the legislation.

Silva, R-Nashua, said the House will work to override the governor's veto next week. In a time when people have to show ID to get on a plane, bus or to enter a federal building, he said requiring voters to present identification is "not a major imposition."

Senate Majority Leader Jeb Bradley and bill sponsor Sen. Russell Prescott also issued a statement responding to the governor's veto.

Bradley, R-Wolfeboro, said he was "disappointed" by Lynch's decision.

Prescott, R-Kingston, pledged to work with the governor, the House, and the Secretary of State to address Lynch's concerns in the next week "so that this bill may move forward."

The Voter ID bill was one of four bills vetoed by the governor on Thursday. He also vetoed SB 409, which would have legalized the use of marijuana for medical purposes.

"Under this bill, the number of potential marijuana cultivation sites is virtually unlimited," Lynch said in his veto message. "The distribution of marijuana under SB 409 cannot effectively be controlled, with the result being the proliferation of marijuana for medical use."

Lynch is just catering to his left wing party, who wants all the illegals to vote in the upcoming election.....sadly, he does not represent his constituents here in NH who believe in trying to find a way to get to "fair" elections....he should be ashamed of himself......the legislature passed this bill in both houses, and with the support of the citizens and taxpayers of NH....why can't he see that?

Mr. Edmunds, I am a veteran but that has nothing to do with this as there is no law that requires one to serve in order to vote. It is insane to use the honor system with our most important of rights, the right to vote. If the honor system worked our prisons would not be full.

How in the world can ANYONE say "Our election laws must be designed to encourage and facilitate voting by all ELIGIBLE (my emphasis) voters in New Hampshire." when he has JUST struck down the manner in which the poll worker would determine whether the potetntial voter is "eligible".

I gag at the things these people we've elected to office are willing to stand in front of us and say as if it's the absolute truth or anywhere near logical.

I'm not sure if you have been following, but the Governor was on board with this bill UNTIL Republicans chose to strip college students the right to use their I.D.'s to vote.
They also extended the affidavit to make long and cumbersome, AND added a photo booth that would take people out of the voting lines, into another line, and back to the voting line. The States Clerks were horrified at this huge extension of the process.
New Hampshire's Republican legislators are drunk with power, god forbid we allow the Governorship to fall to the Republican this fall....

I don't know if you are aware of it but non-resident college students are issue student IDs so accepting one as proof of residency isn't reasonable.

Republicans not only support resident college students voting rights we openly encourage it. It is the non-residents, those whom are not New Hampshire citizens, we want to discourage from voting illegally in our elections. Why is that so unreasonable?

The right to vote is covered by the 14th and 21st Amendments which were after thoughts. The 2nd Amendment is the work of the Founding Fathers. To obtain and carry a firearm, a constitutionally guaranteed right I must show a government issued photo ID, submit to a background check, pay a fee for a license, and submit to a second background check. If I want to carry it outside of NH I will pay thousands of dollars and jump through unimaginable layers of red tape and will often still be denied my constitutionally guaranteed right. And you're griping about having to show any form of ID to vote?

What does a college ID have to do with citizenship? You can't argue that you have to be a citizen, or even legal, as some states have already approved in-state tuition rate for illegal immigrants. At least with government issued documents there is supposed to be some cross-checking (more with real ID being deployed). I went to school in NJ and could easily have registered there with my college ID and in Mass (my "residence" at the time) with my drivers license. You should only be able to vote where you declare your residence, and if you can't make it, that's what absentee ballots are for.
I don't want to suppress anyone's rights to vote except those that don't have the right to begin with.

Anyone can get a college ID these days, even if you actually reside in a foreign country. To get a government form of ID you need to prove that you are actually a citizen of the United States, a college ID does not provide this. Having a government ID (whether Federal or State) provides me with another sense of security. You don't need a college degree to figure that out.

To register to vote you have to be an American citizen. The issue isn't that illegals will be voting, the issue is that American citizens who can't afford a passport or a driver's license are losing their right to vote because of government bureaucracy. Plus, there is hardly any voter fraud across the country since the Florida disaster. Taking away an individual's right to vote because they can't afford an ID is unconstitutional.

Jon B., What part of free don't you get? As to illegals not voting how would we know? The current system is they send a letter to someone who registers at the polls who doesn't have an ID. If an illegal alien uses there really mail address and doesn't return the letter then according to Governor Lynch and his AG no crime has been committed. You are so concerned about protecting the 14th and 21nd Amendments, what about the 2nd Amendment? I need an ID, background check, license and second background check, and there is a fee. How is that not unconscionable as well?

You wouldn't be required to have a drivers license just a government id or liquor id. No one is saying you need a drivers license. It is ridiculous that we have 90 year old ladies sitting in a cafe of a school or church who cant even see 3 feet in front of them letting people vote solely on name and address. America is a privilege not a right. You should be able to walk into a voting location with your head held high and vote for what you believe in. I would be honored to show my ID as an American citizen and do whats right for my country. Verify that you are a citizen and you can vote. As simple as that.

Last time my family voted, we had to show an ID even though we were registered voters. I liked that, for I would not have been happy to find out that somebody claimed to be me and had already voted. In New Mexico and Washington state illegals can get a drivers license with just proof of address. About 92,000 foreign national licenses have been issued in New Mexico since 2003, only 16,000 of them can be verified as residence. It is turning into a less then disirable situation. We should learn from what works and does not work from other states that have already tried similiar.
Those that should not have these licenses, but have one already have proof of ID as was required before Lynch vetoed this bill. So either way we will have non U.S. Citizens voting that should not be, for this bill said for an I.D. from another state will qualify you.
I do not want to make it easy for someone, U.S. Citizen, or not just to walk in and vote for myself, or change my status from Independent to another political party. I want to vote for me, I want them to ask for an ID so they know it is me and not somebody else.

With nearly 80% of Americans supporting medical marijuana & over 50% now favoring legalization Governor Lynch is putting his personal bias before the will & needs of his constituents. Here's hoping that Governor Lynch dies a horrible & painful death due to a lack of doctor recommended medication,the sooner the better !

Wishing someone dead? Well, that's a bit harsh, don't you think Summer?

And the problem isn't the MJ - its the bill that makes it legal. Without proper safeguards - and forethought on what could go wrong - it could be opening the door to all kinds of problems.

Personally I think it should be like beer - brew (or grow) for your own use - legal - anything for sale needs safety checks so it should be sold at the liquor store. Hey! Collect tax on it!
